Terms and Conditions

Welcome to SKITZ. By renting ski gear from us, you agree to comply with and be bound by the following Terms and Conditions. Please read them carefully before completing your rental.
1. Rental Agreement
1.1 Rental Period
The rental period will begin the second day of the dates you selected, as the first day is a buffer day (the day the shipment will arrive at your house), and it will end the day before the final day, as the final day is also a buffer day (the day given to you so you can ship it back)
1.2 Rental Fees
The rental fees for the gear are outlined on our website or provided during booking. Payment is required at the time of booking or at pickup. Fees are non-refundable, unless cancellation is made 2 weeks in advance to your rental period, then you will receive a 75% refund.
2. Gear Responsibility
2.1 Condition of Gear
Upon receiving the gear, you agree to inspect the equipment for any visible damage or defects. If there is any pre-existing damage or issue, please notify us immediately. Failure to do so may result in you being held responsible for the damage upon return.
2.2 Use of Gear
You agree to use the SKITZ safely and responsibly, in accordance with all applicable laws, regulations, and manufacturer recommendations. The equipment is for personal use only and must not be resold or transferred to another person, or else will result in a fine above $500
2.3 Maintenance and Care
You agree to return the gear in the same condition it was rented to you, excluding normal wear and tear. You are responsible for any damage or loss that occurs during the rental period, including damage caused by improper use, neglect, or failure to properly care for the gear.
2.4 Lost or Stolen Gear
If the gear is lost or stolen during the rental period, you are responsible for the full replacement cost, which may include additional fees. In the event of theft, a police report must be filed, and a copy must be provided to us.
3. Liability and Assumption of Risk
3.1 Assumption of Risk
You acknowledge that skiing and snowboarding are inherently dangerous activities, and you participate at your own risk. You agree to assume full responsibility for any injury, damage, or loss incurred during the use of our rental gear.
3.2 Limitation of Liability
To the fullest extent permitted by law, SKITZ shall not be liable for any direct, indirect, incidental, special, or consequential damages, including but not limited to personal injury, property damage, or loss of income, arising from the use or misuse of rental equipment.
3.3 Insurance
We recommend that you have appropriate travel or accident insurance that covers injuries and damages while participating in skiing or snowboarding activities. Our rental insurance coverage does not cover personal injury or property damage.
4. Returns and Refunds
4.1 Return Policy
All gear must be on its way back to our warehouse by the end of the rental period. Once it is on its way back, your rental period is over. If the gear is not on its way back, you will be subject to late fees, which is $10 per day.
4.2 Refunds
Refunds are only acceptable further than two weeks in advance to the first day of your rental period. If you decide to get a refund, you will receive up to an 85% refund, depending on the date of cancellation.
5. Booking and Cancellations
5.1 Booking Process
Reservations for rental gear should be made in advance via our website or by phone. A valid credit card is required to secure your booking, and must be made further than two weeks in advance.
5.2 Cancellations and Modifications
If you need to cancel or modify your reservation, please contact us at least two weeks before to receive a refund. If a cancellation is made within the two week mark, there will be no refund given or compensation given. No cancellations or changes will be accepted after the rental period has begun.
6. Privacy and Data Collection
6.1 Personal Information
By renting from us, you consent to the collection and use of your personal information in accordance with our Privacy Policy.
6.2 Data Security
We take reasonable measures to protect your personal data, but we cannot guarantee complete security. By using our service, you acknowledge the potential risks involved in transmitting personal information over the internet.
7. Indemnification
7.1 Indemnification
You agree to indemnify and hold harmless SKITZ, its officers, employees, and agents from any and all claims, losses, liabilities, damages, or expenses (including legal fees) arising out of or related to your use of the rental gear or any violation of these Terms and Conditions.
8. Governing Law and Dispute Resolution
8.1 Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of Texas, without regard to its conflict of law principles.
8.2 Dispute Resolution
Any disputes arising out of or in connection with these Terms and Conditions shall be resolved through [mediation/arbitration] before a neutral third party, or if necessary, through the courts in [Jurisdiction].
9. Changes to Terms
9.1 Modification of Terms
We reserve the right to update or change these Terms and Conditions at any time. Any changes will be posted on our website, and your continued use of our services after such changes constitutes your acceptance of the updated Terms and Conditions.
